Suspects who assist in bribery cases may soon be spared prosecution
A proposed amendment would empower the Director General of the Commission to Investigate Allegations of Bribery or Corruption (CIABOC) not to institute proceedings against, or to withdraw proceedings already instituted against, an accomplice suspect involved in an allegation of bribery or corruption, if the suspect truthfully discloses all the facts known to them regarding the offence.
The amendment is included in the Bill published on the instructions of President Anura Kumara Dissanayake to amend the Anti-Corruption Act, No. 9 of 2023.
Under the proposed amendments, the Director General’s existing authority, which is currently limited to cases before the High Court, would be expanded to include the withdrawal of cases instituted before Magistrates’ Courts.
The amendments also propose recovering the value of property obtained through corruption or otherwise converted through corruption, while appointments, privileges, benefits or other advantages obtained through corruption would be deemed unlawful from the date on which the person is convicted.
In addition, the amendments include provisions to second officers of the Provincial Public Service and police officers to the Commission to Investigate Allegations of Bribery or Corruption, either on a permanent or temporary basis.
