Justice Minister clarifies decision to extend judges’ retirement age

The Justice Minister Harshana Nanayakkara has said that the decision to extend the retirement age of judges was taken as part of measures to improve the efficiency of Sri Lanka’s judicial system and address a backlog of more than 1.1 million cases.

Joining this week’s Cabinet briefing held earlier today (July 28), he said that by extending the service period of experienced judges, the government hopes to ensure that courts benefit from their expertise while addressing delays caused by heavy caseloads.

He pointed out that Sri Lanka currently has around 20 judges per one million people, compared with 40 – 60 judges or more per one million people in many developed countries.

 The Cabinet of Ministers yesterday (July 27) approved a proposal to raise the constitutionally prescribed retirement age of judges, as part of a wider reform package aimed at making judicial proceedings more efficient and orderly.

According to the government, the move is only one component of a wider strategy aimed at enhancing the effectiveness of the judiciary.

The move has met with criticism from several fronts.

Responding to criticisms, the Justice Minister said the reform was not aimed at any individual or a specific court, but would apply across the judiciary.

He also pointed out that the retirement age of judges has not been revised since 1978.
